Terms and Conditions

1. Agreement to Terms

By accessing or using the services of Eclipse Heating and Air Conditioning, Inc. ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, users, and customers who access or use our services.

2. Services Description

Eclipse Heating and Air Conditioning, Inc. provides heating, ventilation, and air conditioning (HVAC) services including but not limited to:

  • Installation of new HVAC systems and equipment
  • Repair and maintenance of existing systems
  • Indoor air quality assessments and improvements
  • Emergency repair services
  • Preventative maintenance programs
  • Ductwork installation and cleaning

3. Service Estimates and Pricing

  • All estimates provided are valid for 30 days unless otherwise specified.
  • Estimates are based on information provided and may be adjusted upon on-site inspection.
  • Additional work discovered during service will be communicated and approved before proceeding.
  • Prices are subject to change without notice; however, quoted prices will be honored for the validity period.
  • The online calculator provides estimates only and does not constitute a binding quote.

4. Payment Terms

  • Payment is due upon completion of services unless other arrangements have been made in writing.
  • We accept cash, checks, and major credit cards (Visa, MasterCard, American Express, Discover).
  • For installations over $2,500, a 50% deposit may be required before work begins.
  • Late payments may be subject to a 1.5% monthly finance charge.
  • Customer is responsible for all collection costs, including reasonable attorney's fees, if payment is not made as agreed.

5. Warranty Information

Labor Warranty: Eclipse HVAC provides a one (1) year warranty on labor for all repairs and installations, beginning from the date of service completion.

Parts Warranty: Manufacturer warranties apply to all parts and equipment. Warranty periods vary by manufacturer and product. We will assist with warranty claims for parts we have installed.

Warranty Exclusions: Warranties do not cover:

  • Damage caused by misuse, neglect, or lack of maintenance
  • Damage caused by natural disasters, power surges, or acts of God
  • Repairs performed by unauthorized parties
  • Normal wear and tear or consumable parts (filters, batteries)
  • Pre-existing conditions not disclosed at time of service

6. Maintenance Plan Terms

  • Maintenance plans are annual agreements that automatically renew unless cancelled.
  • Cancellation requests must be made at least 30 days before renewal date.
  • Refunds for cancelled plans will be prorated based on services already rendered.
  • Plan benefits (discounts, priority service) are non-transferable.
  • Missed scheduled maintenance visits are forfeited and cannot be carried over.

7. Scheduling and Cancellation

  • We strive to arrive within the scheduled service window. Delays may occur due to unforeseen circumstances.
  • Customers must provide at least 24 hours notice for appointment cancellations.
  • Cancellations with less than 24 hours notice may be subject to a $50 cancellation fee.
  • No-shows (customer not present for scheduled appointment) will incur a $75 trip charge.
  • Emergency services are subject to availability and additional charges may apply.

8. Customer Responsibilities

Customer agrees to:

  • Provide accurate information about HVAC systems and service needs
  • Ensure safe and accessible working conditions for our technicians
  • Secure pets and provide clear access to equipment
  • Be present or have an authorized adult present during service calls
  • Inform us of any known hazards (asbestos, electrical issues, structural concerns)

9. Limitation of Liability

To the fullest extent permitted by law, Eclipse Heating and Air Conditioning, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to our services. Our total liability shall not exceed the amount paid by the customer for the specific service giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Eclipse Heating and Air Conditioning, Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your violation of these Terms and Conditions or your use of our services.

11. Dispute Resolution

Any disputes arising from these terms or our services shall first be addressed through good faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Los Angeles County, California, in accordance with the rules of the American Arbitration Association. This agreement shall be governed by the laws of the State of California.

12. Intellectual Property

All content on this website, including text, graphics, logos, and images, is the property of Eclipse Heating and Air Conditioning, Inc. and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

13. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified terms.
